Terms of Service Agreement

1. Introduction

skeleton social is a wholly owned subsidiary of Skeleton Studios LLC. By using our services, you agree to be bound by the following terms and conditions (the "Terms of Service" or "Agreement"). Please read them carefully.

2. Acceptance of Terms

By accessing or using the skeleton social app (the "App"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you may not use the App.

3. License Grant

skeleton social grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes, in accordance with these Terms of Service. For detailed terms of the license, please refer to the End User License Agreement (EULA) available at https://www.skeletonsocial.app/eula.

4. Description of Services

skeleton social provides a minimal content social networking platform with features such as states, syndicates, syncs, and syndicate syncs (the "Services"). The Services are provided by skeleton social, a wholly owned subsidiary of Skeleton Studios LLC. The App is available on iOS, Android, and web platforms.

5. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this eligibility requirement.

6. Account Registration

To access certain features of the App, you must register for an account. During registration, you may need to enter an invitation code. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

7. Subscription Levels

skeleton social may introduce a paid subscription model in the future. This may or may not include various subscription tiers that provide different features and benefits, such as:

1. Standard: Limited syncs, basic search, standard privacy.

2. Superior: Unlimited syncs, advanced search, enhanced privacy features (e.g., ephemeral messages).

3. Supreme: All superior features plus exclusive content, access to events, priority support, and early access to new features.

These subscription levels may include additional features and benefits as announced. Subscription fees and the features provided at each level are detailed within the App if and when they become available. By subscribing, you agree to pay the applicable fees and adhere to any additional terms associated with your subscription level. Subscriptions are managed through your account settings and can be canceled at any time. Refunds will be processed in accordance with standard refund policies applicable in your jurisdiction.

8. User Conduct

Users are expected to conduct themselves in a manner that strives for open dialogue, inspiration, creativity, and positivity. You agree to respect the legal and ethical boundaries while using the App. You agree not to use the App for any unlawful or prohibited purpose. You are responsible for all your activities in connection with the App and must abide by all applicable local, state, national, and international laws and regulations. Prohibited conduct includes, but is not limited to:

  • Posting content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

  • Engaging in harassment, bullying, or hate speech.

  • Impersonating another person or entity.

  • Engaging in any activity that interferes with or disrupts the App or the servers and networks connected to the App.

  • Using the App for any commercial purpose without prior written consent from skeleton social.

9. Posting Copyrighted Material

You agree not to post any content that infringes on the intellectual property rights of others, including but not limited to copyrights, trademarks, and patents. You are responsible for ensuring that any content you post on the App is either your own original work or you have obtained the necessary permissions or licenses to use it. Posting copyrighted material without proper authorization is strictly prohibited.

10. Moderation Clause

Moderation of Content: skeleton social reserves the right to review, monitor, and remove any content posted on the App at its discretion, especially content that violates these Terms of Service or is deemed inappropriate.

11. Reporting Infringements

Reporting Mechanism: If you believe that any content on the App infringes your intellectual property rights, please contact us at team@skeletonsocial.app with detailed information about the alleged infringement.

12. Content Ownership

You retain ownership of the content you post on the App. By stating states (posts) in the general feed, you grant skeleton social a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the App and skeleton social's (and its successors' and affiliates') business, both on and off the platform. Syncs (chat messages) are always private and cannot be accessed by the company.

13. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy (https://skeletonsocial.app/privacy), which explains how we collect, use, and disclose information that pertains to your privacy. The Privacy Policy is incorporated into these Terms of Service by reference.

14. End User License Agreement (EULA)

By using the App, you also agree to comply with and be bound by our End User License Agreement (EULA) (https://skeletonsocial.app/eula), which provides additional terms and conditions specific to the use of our software. The EULA is incorporated into these Terms of Service by reference.

15. Termination

skeleton social reserves the right to suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. For specific consequences of termination, please refer to the End User License Agreement (EULA) (https://skeletonsocial.app/eula).

16. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. skeleton social does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

17. Limitation of Liability

To the maximum extent permitted by law, in no event shall skeleton social, Skeleton Studios LLC, its directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory.

18. Indemnification

You agree to indemnify and hold harmless skeleton social, Skeleton Studios LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms of Service.

19. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the state of your local region, state and country, without regard to its conflict of law principles. For users located outside of the United States, local consumer protection laws may apply.

20. Changes to Terms of Service

skeleton social reserves the right to modify these Terms of Service at any time. We will notify you of any changes by posting the new Terms of Service on the App. Your continued use of the App after the posting of the new Terms of Service constitutes your acceptance of the new terms.

21. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms of Service, you agree to first contact us at team@skeletonsocial.app to attempt to resolve the dispute informally. If we are unable to resolve the dispute informally, any dispute, controversy, or claim arising out of or relating to these Terms of Service or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in your state before a single arbitrator. The arbitration shall be administered by the American Arbitration Association (AAA) pursuant to its Comprehensive Arbitration Rules and Procedures.

22. Monetization Features

skeleton social may introduce monetization features, including paid subscriptions and/or subscription tiers, in the future. Details of these features and their associated terms will be provided at the time of their respective introduction.

23. Refund Policy

Upon the prospective introduction of monetized features, all subscriptions are subject to our standard refund policy. Refund requests must be made within 14 days of purchase. Refunds will be processed based on the payment method used and may take several business days to appear in your account.

24. Additional Features

skeleton social reserves the right to add new features or modify existing features, including any subscription level. Such changes will be communicated through the App.
